Florida woman files lawsuit against hospital for allegedly flushing her miscarried baby

A woman is suing a hospital in Florida after an employee has reportedly flushed down the remains of her miscarried child down the toilet.

According to Pix 11, Linda Gomez has filed a lawsuit last week against Wellington Regional Medical Center in the southern city of Wellington. The lawsuit indicates that an employee from the hospital has flushed down the remains of her miscarried child in the toilet.

Her attorney, Kennan Dandar, said she went to the hospital to seek advice on her bleeding during her 19th week of pregnancy and while waiting for a doctor, she went to the bathroom where the miscarriage took place. She reportedly cut the umbilical cord herself after being unable to summon help.

However, CBS News reported that the complaint further says that an employee went in to help but when she saw the baby in the toilet, she flushed it. Gomez added that she screamed at the employee to stop the action and that she could still see her baby's face as it was flushed. The suit also claims that she was sent back to the waiting room after the incident. The lawyer said his client asked the hospital to try and retrieve the baby so she could give her a proper Christian burial but they refused her request.

Court House News wrote that Gomez has sued them for negligence and infliction of emotional distress after they deprived her of a proper burial. The plaintiff says she lost her chance to provide a proper burial which conforms to her Christian faith. Her lawsuit further explains she will "experience emotional harm and mental anguish, medical and psychological expenses, and loss of enjoyment of life."

The complaint was made public upon its assignment to a circuit division on March 25, 2016. Wellington Regional's public relations department hasn't responded for a comment.
