A former live-in personal gym trainer for Putnam District Attorney Adam Levy, who was acquitted for raping a teenager, is suing Putnam County officials for the rape claims. The said gym trainer claims the evidence for the teen rape case were manufactured.
Alexandru Hossu filed a $45 million federal lawsuit claiming, that the Putnam county officials, "wrongfully" put him on trial on charges of raping the 13 year old daughter of his former girlfriend in 2010, Iohud reported. On his 43-page complaint, the defendants include, Putnam Sheriff Donald Smith, three senior officials in that office, and two Westchester County prosecutors.
The case had been handled by the Westchester District Attorney's office after Levy, son of television personality Judge Judy Sheindlin, recused his office from the case.
Hossu was accused twice of raping the teen at her home in Brewster, New York, according to HNGN. He faced two counts of first-degree rape, two counts of second-degree rape, and endangering the welfare of a child. The teen's mother was also Levy's girlfriend at the time.
"To have to go through what that man went through is inhuman," Mentzer said. "Where does this man go to get his reputation back?" Daniel Mentzer, Hossu's defense lawyer said. Prosecutors refuse to comment regarding the acquittal verdict.
Because of lack of forensic evidence, the prosecutors focused their defense on the victim's testimony, which is now a high school junior, USA Today reported. According to the victim, Hossu "snapped", choked and raped her for three hours. She was left in "excruciating pain, with blood all over her bed."However, defense said, the girl's testimony was implausible.
When the case did go to trial after Levy leave the case, Daniel Mentzer, Levy's brother-in-law, represented the defendant. Hossu said the girl hated him because she thought her mother began dating him too soon after her father died in 2006. He said investigators and prosecutors manufactured evidence and withheld exculpatory evidence in the case.
His lawsuit also claims that investigators for the sheriff's office knew that the alleged victim was unreliable and had altered her story on several occasions. He also believes, the rape allegations is part of a political vendetta against Levy, the son of television's Judge Judy.
