Alleged serial killer Anthony Garcia deemed mentally competent for trial, claim Doctors

By

Accused serial killer from Omaha, Anthony Garcia, is deemed mentally competent to stand trial by three doctors after months of evaluation. Two of the doctors also stated that Garcia's claims of being sexually assaulted while in detention are concocted.

According to WOWT, an investigation on Garcia's competency to stand on trial begun months ago after it was revealed in a jail form signed by Garcia about his statement to a doctor that he had been sexually assaulted by officers and staff from Douglas County Correctional Center and the Lincoln Regional Center.

Garcia's mental evaluation took months and further delayed the litigation of the case against him. According to KETV7, Garcia is accused of the murder of Dr. Roger Brumback and Mary Brumback in 2013 as well as Thomas Hunter and Shirlee Sherman in 2008.

The alleged motive for the killings is revenge for being fired from his medical residency in Creighton University. Garcia was evaluated by a psychiatrist and psychologist from Lincoln Correctional Center and a private practice psychiatrist from Kansas City.

The doctors claim that Garcia wouldn't cooperate during evaluations, thus, their findings are based only on observations. No evidence was obtained either pertaining to Garcia's claim of sexual assault while in custody.

According to Garcia's lawyer, Robert Motta II, the defendant was also saddened by the delay as he also wants to proceed with the trial. "He wants to go to trial," Motta said. "Which was exactly the point: Why would he linger and lie about things? He doesn't want to say in the state hospital. He doesn't want to delay trial. He never has."

As reported by Omaha, Motta also claimed that he expects the trial to have its heated moments like the event last Thursday as the state and the defendants went on bickering as they prepare for Garcia's trial. The prosecutors also previously filed sanctions against Motta's wife for its alleged witness-intimidating actions.

Motta said that they are going to fight on Garcia's case, especially that it is a death penalty case. Judge Duane Dougherty is expected to declare Garcia as competent for trial in the next few days. The defendant's trial is expected to take place in April 4.
