In a surprise ruling, a federal appeals court tossed out ex-Rep-Jeff Fortenberry's conviction for lying about unlawful campaign contributions on Tuesday, citing an intriguing jurisdictional error.

Donato added that this unforeseen outcome didn't align with the Constitution, effectively reversing Fortenberry's convictions so he could be retried in a proper venue if prosecutors still opt to.

What's The Next Course of Action For Prosecutors And Fortenberry?

Where does that leave the Justice Department and, more essentially, Fortenberry himself? The Department still needs to clarify whether it intends to retry Fortenberry. If they decide such, federal prosecutors should bring charges in Nebraska or Washington, D.C., essentially hitting the restart button on the case. The Central District of California's U.S. attorney's office didn't immediately respond with a comment.

Fortenberry Expresses Relief After Appeals Court Decision

Reacting to the surprising turn of events, "The Ninth Circuit's decision gratifies us," Fortenberry told CNN on Tuesday. "Celeste and I would like to thank everyone who has stood by us and supported us with their kindness and friendship."

Fortenberry had stepped down from office following his conviction last year, saying at the time that he could "no longer effectively serve." This retrial could, however, put him back on the political map if he's acquitted of the allegations that continue haunting the former congressman.
