Musk's X Faces Lawsuit for Withholding Staff Bonuses, Oral Promise to Pay Is Binding and Enforceable

The issue stems from allegations that X failed to meet bonus payment obligations after its acquisition by billionaire Elon Musk in October 2022. This grave accusation was instigated by Mark Schobinger, formerly a senior director of compensation at X. He filed the suit in a San Francisco federal court after he departed from the company in May. US District Judge Vince Chhabria announced last week that Schobinger's case against X seemed credible and advanced its hearing. He declared, "Twitter's offer to pay him a bonus in return became a binding contract under California law."

Interestingly, X, once a key player in the field of public relations, chose not to comment on CNN's request for input on this matter. Their previous stance centered around the argument that oral promises aren't legally binding. They suggested the case should be shifted to Texas for a hearing, but Judge Chhabria firmly stated that California law prevails in matters of contractual enforcement.

This case has arisen after numerous employees raised questions about their compensation post-Musk acquisition, especially concerning their annual bonus.

Did X Fallback on Promised Bonuses?

In the months leading up to the acquisition, X executives constantly reassured employees that 2022 bonuses would be paid at 50% of the target, as stated in the complaint. The narrative continued along the same lines after Musk took over.

However, these repeated promises sadly didn't translate into the actual payment of bonuses, claims the lawsuit. Schobinger's departure from X in May was reportedly a result of several unfulfilled promises, including the failure to deliver on promised bonuses.
