VoIP-Pal announced Tuesday to sue Apple Inc in an infrigement case. The company claimed to have a $2.8 billion in damages from concepts used in Appple's services of Wi-Fi Calling, FaceTime and iMessage. The company said to have tried contacting Apple to reach settlement.
Voip-Pal claimed to have the patent for that Apple has infringed upon via services such as iMessage, Wi-Fi Calling and FaceTime, as Uber Gizmo reported. It also said to have been trying to negotiate with Apple to reach resolution before filing the lawsuit. Voip-Pal will also go after AT&T and Verizon with lawsuits.
"Apple employs VPLM's innovative technology and products, features, and designs, and has widely distributed infringing products that have undermined VPLM's marketing efforts. Instead of pursuing independent product development, Apple employed VPLM's innovative caller attribute classification and routing product design, in violation of VPLM's valuable intellectual property rights," the lawsuit cited.
Prior to the lawsuit, VoipPal advisor and mediator Ray Leon said to have initiated discussion with Apple and other companies to discuss amicable resolution, according to Business Wire. He has either personally met or spoken with representatives from the Defendants, and he will continue to engage in ongoing discussion with them.
CEO of Voip-Pal Emil Malak stated the company's intention is to seek favorable outcome with the Defendants. The company had filed a combined $7 billion patent infringement lawsuits. The lawsuits were first filed in February 2016 in the United States District Court, District of Nevada.
After few months of negotiation, last Monday Voip-Pal officially served Apple, Verizon and AT&T in a series of lawsuit. The case against Apple Inc. is filed in Case No. 2:16-CV-00260, while Case No. 2:16-CV-00271 is against Verizon Wireless Services, LLC, Verizon Communications Inc., AT&T, Inc., and AT&T Corp
"Serving the parties in these lawsuits does not end our discussions with the Defendants. We are confident the current good will on both sides will result in a favorable outcome for all parties involved," said Emil Malak.
Voip-Pal com Inc .is a publicly traded company with headquartered in Bellevue, Washington. It owns a portfolio of patents related to VoIP technology that it wanted to monetize. The company also announced a shareholder conference call scheduled for Wednesday May 25, 2016 at 12:00 PM ET. The purpose of the conference call is to answer questions from its current and prospective shareholders.
According to Apple Insider, Voip-Pal seek a 1.25% royalty rate based on iPhone, iPad, and Mac profits in its lawsuit against Apple. Specifically, Voip-Pal accused Apple Inc to exploit patents related to "caller attribute classification and routing product design" owned by Voip-Pal.
