Five Finger Death Punch Metal Band Sued By Own Record Label For Breach of Contract

Metal band Five Finger Death Punch faces a breach of contract lawsuit filed by their record label. The legal complaint, which was filed at the Los Angeles Supreme Court, claims the band is starting to work on their new music without the consent of the company and has declined to work with them.

Prospect Park, the Las Vegas metal band's label, also alleges that the members of Five Finger Death Punch are "shamelessly" trying to "cash in" before the anticipated downfall of their "addicted bandmate," who was identified as their front man Ivan Moody, Billboard cited.

The metal band has been under the label since December 2012. On the terms and condition of the contract, the band is not allowed to record a new album, "any earlier than the date which is nine months after the release of the immediately preceding" (recorded album), unless it is approved in writing by the label.

However, according to Prospect Park, the band started to work on a new album in another recording label, WAAF reported. The group released their third album "Got Your Six" on 4th of September 2015 and are still not allowed to start working on their fourth album until after June this year.

Prospect Park alleges they ignored their contractual obligations due to the possibility that their vocalist will not recover and end his career. It isalso claimed that the member of the band are taking advantage of Moody's state in order to profit. Moody has been fighting his alcohol addiction, which the record label sees as putting the band and his life "at risk".

Five Finger Death Punch responded to the lawsuit saying they were saddened about it, but they "were not surprised," Loudwire reported. They also called out Prospect Park's CEOm Jeff Kwatinetzm for "abusive bullying tactics." Moreover, the members clarified Ivan Moody's condition, stating the vocalist is in rehab supported by them and his family.

The lawsuit is seeking compensatory damages; temporary, preliminary and permanent injunctions; a declaratory judgment that FFDP have breached their contract and that Moody is mentally and physically unable to perform as required by contract; and recovery of attorney's fees.
