Judge Granted Bill Cosby's Request to Temporary Delay 1974 Sexual Battery Lawsuit

Comedian actor Bill Cosby wins a temporary delay in a 1974 sexual battery lawsuit case filed by a woman in California. The small victory was ruled by the Los Angeles Superior Court Judge Wednesday, whom said it was justified, as the comedian will have time to resolve another separate criminal case in Pennsylvania.

According to USA Today, Los Angeles Superior Court Judge Craig Karlan granted Bill Cosby a temporary postponement, in the the deposition in which he will not have to answer more questions under oath in a lawsuit from Judy Huth. Huth claims the comedian of forcing her into a sex act when she was 15 at the Playboy Mansion, in 1974.

However, the judge also told that the ruling does not mean Huth's sexual battery case will be freeze. "I don't want this case to be here three, four, five years from now. That's not justice," Karlan said. Christopher Tayback, Cosby representing attorney said in six months, he is expecting that his client will be exonerated in the case.

Last year, the comedian already gave his sworn testimony for the said case, however, the judge ordered him to answer more questions under oath in a deposition, the Press Enterprise reported. The decision of the judge on Wednesday will protect him from an immediate deposed.

Attorney Gloria Allred, the lawyer that represents Judy Huth is against the actor's motion to delay the case from going forward in order for the 78 year old comedian to focus on the sexual assault charge in Pennsylvania. Allred said, the case may go slow, however the case will not be halt. According to Deadline, the lawyer for Huth mentioned Playboy founder Hugh Hefner, as a potential witness, for the added questions in deposition.

Dozens of women have accused Cosby of sexual abuse, but the statutes of limitations in most instances have passed. On Tuesday, a judge rejected a motion by Cosby's lawyers to dismiss a defamation lawsuit by model Janice Dickinson. Cosby's lawyers say they believe the case should be dismissed and are considering an appeal.
