Bill Cosby Sues Rape Accuser For Breaching Confidential Settlement

Bill Cosby is suing his accuser, Temple University employee Andrea Constand, her mother, her two lawyers and the parent company of the National Enquirer. The disgraced American comedian alleges in a breach of contract lawsuit that Constand and her mother revealed information even after their financial settlement.

Cosby filed a breach of contract lawsuit against Andrea and her mother Gianna Constand in February. In 2005, Constand accused the 78-year-old actor for drugging and molesting her. A year after, they settled the matter secretly after Constand received payment for her silence. The Guardian reports that Cosby now wants his money back after the rape accuser has violated their agreement. According to the lawsuit, Constand and her mother are Canadian citizens, and they disqualified when they joined in the reinvestigation of Constand case against Cosby which reopened in 2015 in Pennsylvania.

"Both Andrea and Gianna Constand voluntarily sat for interviews with the district attorney, even though they were under no legal obligation to do so and the terms of the Confidential Settlement Agreement expressly prohibited such conduct," Cosby's attorneys wrote.

Constand's lawyer, Dolores Troiani is also being sued by Cosby as she reportedly turned the files of Constand over to the authorities. The files were allegedly shared by the lawyer after the criminal investigation was reopened. Cosby claimed that it was a violation in their settlement, according to Hollywood Reporter. The lawsuit also claims that Constand and her lawyer disclosed the full deposition of Cosby in 2005 that he drugged a number of women in order to have sex with them.

Apart from Constand, her mother, and her lawyers, Cosby is also filing a lawsuit against the parent company of the National Enquirer, the American Media. According to Camille Cosby's husband, the newspaper violated its contractual obligations when it published several stories against him, News Day claims. The publishing allegedly reported numerous articles, including "World Exclusive: Bill Cosby Will Die in Jail," and "99 Victims in 43 Years for Bill Cosby!" and "Saved by the Bell Star Accuses Bill Cosby, Martin Lawrence, and John Travolta of Abuse.

"Defendants are blatantly violating their confidentiality obligations under the 2006 Confidential Settlement Agreement," Cosby's attorneys wrote, "including by intentionally disclosing information they promised to keep confidential as consideration for the settlement.

Cosby is now seeking punitive damages and restitution after Constand and her camp reportedly breached their settlement. The information containing the settlement of Cosby and Constand appeared to be redacted. The former "Uptown Saturday Night" star is set to attend a preliminary hearing on March 8 for the felony case. If he will be proven guilty, then he could be sentenced of up to 10 years.
