Lawsuit vs. Kesha, mom dismissed by NY judge; Court hearing on singer's dispute against Dr. Luke set this month

A lawsuit filed by producer Dr. Luke against Kesha's mother, Pebe Sebert. and her manager were dismissed by a judge in New York. Dr. Luke's legal team is considering the idea of filing an appeal, although, a case of the same nature is currently ongoing in Tennessee against Sebert.

Producer Dr. Luke, whose real name is Lukasz Sebastian Gottwald filed a lawsuit against Kesha and her mother in 2014 for alleged defamation and breach of contract. Per TMZ, the case has against Sebert had been ongoing since October 2014 and was dismissed this week by New York Supreme Court Justice Shirley Kornreich for issues in the jurisdiction as well as lack of proof that Kesha is being controlled by her mother.

Luke sued Sebert for allegedly attempting to extort him if he refuses to let Kesha out of her deal and for fueling Kesha's anger towards her contract. However, a similar active lawsuit was filed by Dr. Luke against Sebert in Tennessee.

Furthermore, the New York judge's ruling also dismissed Dr. Luke's accusation against Kesha's manager, Jack Rovner of Vector Management. According to Billboard, Dr. Luke claimed that Rovner is jealous and has an ill relationship with him after he turned down Rovner's suggestions about creative and business matters.

Dr. Luke's side claimed that Rovner is angry at him for rejecting his proposals. The suit claimed that Rovner was the former head of a record label and is used to being treated like a 'boss' however, Dr. Luke's treatment of him and his suggestions were not taken well by Rovner.

Judge Kornreich ruled in favor of Rovner stating that the defendant was working within the limitations of his job as Kesha's manager. "The cases require a showing that the agent acted outside the scope of his authority, in bad faith, and committed an independent tort. Even assuming hatred and jealousy amount to bad faith, they are not torts.", the jduge stated.

The lawsuit between Kesha and Dr. Luke will continue as the singer seeks freedom from her contract with Sony. According to Mail Online, Kesha filed a preliminary injunction in October 2015 stating that her career is not moving forward and could be over soon if she will not be given a chance to record with another label.

Kesha also claimed sexual assault, sexual harassment and emotional abuse against Dr. Luke. In a video message, Kesha expressed her frustration about the issue and thanked fans who supported her and mentioned that she is not allowed to release her songs for the mean time. The singer's lawsuit is moving forward as she is set to appear in court later this month.
