In last season's finale, the real story of the night Scotty was killed was revealed according to Christian Today. After being told that he was not the father of Alison's daughter, Noah sought comfort from his ex-wife Helen at a bar. They left together after reminiscing their past and they appeared to be in the brink of a reconciliation.
Noah was driving but he had to switch places with Helen since he was in no condition to drive. While she was driving, Noah held and caressed her hand that made Helen take her eyes off the road for a split second. It was then that their car hit a man who turned out to be Scotty.

A completely drunk Scotty saw her and when he realized he could not get her to include him in her business partnership with Cole, he attempted to rape her. She pushed him toward the road only to be hit by the car Helen was driving.
Noah saw Alison hiding behind the bushes when he looked around after the accident. She told him what happened and Noah told her to be quiet. He then went on to admit during the trial that he was the driver of the car that caused Scotty his death, therefore protecting both Alison and Helen.

She revealed in an interview that a big change will be on the narrative structure of the show. In the previous two seasons, it was narrated by four persons.
In an interview, EP Sarah Treem revealed that they conceptualized each season of the series to correspond to a different stage of a love affair. Season 1 was the stage of crush while Season 2 was the stage when the charm fades and the couple start to doubt and get obsessed with each other. "The Affair" Season 3 is expected to be darker than previous seasons.
