Finally after three years of talks and discussions, European Union have agreed on the provisions of their Data Protection Law. With this, a stricter supervision over data protection will be implemented which will affect organizations within and outside Europe.
Based on the reports of Blogs Orrick, proposals regarding the data protection law was drafted by the European Commission and was submitted on 2012. Three years after, in the "trilogues meetings," settlement over the provision of the Regulation was reached by the three institutions. The European Parliament and the Council negotiating over it.
Furthermore, according to Nat Law Review, the Data Protection Law includes a General Data Protection Regulation and a Data Protection Direction. These two will overlook the usage of personal data in the private sectors and police and criminal justice respectively. All companies that gives services in the EU will be affected in the implementation of the law as it brings grand modification in the handling of the personal data of European citizens and how to properly keep it in protection.
The law is set to be implemented on 2018 as reported by TechTarget. Though there is still two years more before it will be effective, individuals who are affected by its provision see it to have a great impact on the digital market place as it concerns how to appropriately handle the data of European citizens. TechTarget also stated that this includes also a "stricter and more comprehensive standards regarding data sharing, collection and privacy."
As reported also by TechTarget, the law's main objective is to have an EU data protection provision that can cater to the fast development of technology. Other than that, the law aims also to have an integrated digital market which can make doing business in Europe easier.
The approval of the provision of EU Data Protection Law sets a higher standard when it comes to handling digital data. The intentions of this law is for the good of European citizens. However its implementation will be a challenge to those companies who are offering services in Europe as this regulation will have a stricter data usage implementation.
