Nestle failed to get a trademark for the shape of their iconic four finger chocolate bar. For the second time, Nestle has failed to obtain a trademark for its four-finger shaped chocolate-coated wafer on the Kit Kat bar.

Nestle has filed an appeal after losing a lawsuit to a small Israeli company for using a Hollywood actor lookalike in its spoofed commercials.

Nestle lost a legal battle to trademark the shape of KitKat chocolate bar. British high court ruled on Wednesday that KitKat's shape was not distinctive enough to merit a trademark.
