An Alabama man accused of killing 11 and wounding 29 is asking to be moved out of state prison, claiming his due process rights are being violated.
Damien Laron McDaniel III, 22, is charged with committing two mass shootings in Birmingham, AL.com reported. Aside from the mass shootings, police believe he is responsible for several other murders.
The mass shootings happened near Hush lounge in September and at Trendsetters lounge in July, the website reported.
McDaniel's was convicted and sentenced in April 2023 for a 2019 shooting that happened in Fairfield, Alabama, WBRC reported. In that case, McDaniel's admitted to shooting into a car with two people inside. No one died in the incident, and McDaniel was sentenced to a 15-year split sentence - serving two years in prison and receiving three years probation, the station reported.
With time already served, McDaniel was free in 2024. Before he was charged in the mass shootings and the other murders, authorities had already asked in October 2024 to revoke McDaniel's probation based on an arrest in Birmingham and based on social media posts in which he brandished a firearm, WBRC reported. That request by prosecutors was updated once McDaniel was charged with the 11 murders and a total of 37 felonies.
With the probation revoked in December 2024, McDaniel was sent to state prison to finish his 15-year sentence for the 2019 shooting. He now wants to be moved back to Jefferson County Jail to help in his defense against the current charges pending against him, AL.com reported.
"The defendant's presence at every stage of the proceedings is necessary to ensure his rights to due process, a fair trial, and reliable sentencing," the website quoted his attorney John Robbins.
