A Pennsylvania man who beheaded his own father trying to "perform a citizen's arrest," has been deemed eligible for the death penalty.
Justin Mohn is accused of killing his 68-year-old father Michael Mohn in January 2024 before removing his head and showcasing it during a 15-minute YouTube video calling for a violent overthrow of the US government along with the capture, torture, and killing of federal employees, according to PhillyBurbs.
The Bucks County District Attorney's Office has submitted a notice to retain the option of pursuing the death penalty against the Levittown resident.
The filing cited the aggravated circumstance that the defendant carried out the killing while committing a felony.
NBC10 spoke to Mohn, 34, outside the court following his hearing last month, where he explained that he and a lot of other Americans believe that the federal government has betrayed America.
"They are destroying the country, and we have to do something to take our country back," he said.
The news outlet pressed him on how he believed the slaying of his father would help him further his goals.
"He was a federal employee and betrayed me. I was trying to perform a citizen's arrest. He resisted that citizen's arrest," said Mohn.
The 68-year-old was a retired civil engineer with the US Army Corp of Engineers.
After allegedly killing his father in their family home in Middletown and posting his video, Justin stole his father's car and drove to a military installation in Fort Indiantown Gap, where he was apprehended by authorities.
Law enforcement revealed claims that Justin had trespassed on the military base in an effort to mobilize the Pennsylvania National Guard and convince Gov. Josh Shapiro to "join forces" with him.
The 34-year-old was held for trial on all charges, except for one terrorism-related charge, including felony robbery, theft, and abuse of a corpse.
"It's lawful to use deadly force in that event."
His next court date is scheduled for later this month.
