A man in Nebraska accused of fatally shooting two people outside a strip club in May is demanding that the judge overseeing the case recuse himself.

Christopher Johnson, 32, and his lawyers are requesting Judge Kevin McManaman to remove himself because the bailiff is listed as a witness in the same case.

The defense believes that her presence in the courtroom could influence the court's impartiality, according to 1011NOW.

A hearing has since been scheduled for September 24 to discuss the matter.

Johnson was charged with two counts of first-degree murder and was denied bail.

He now faces the death penalty following the prosecutor's decision to up his charges from Class IA felonies to Class I, the highest possible offense in Nebraska's judicial system.
