Former U.S. President Donald Trump faces accusations. He is thought to have violated a gag order issued by New York Judge Juan Merchan. This issue arises two days before Trump's upcoming Manhattan hush money trial, which is expected to begin on Monday.

What Led to Trump's Indictment?

Manhattan District Attorney Alvin Bragg carried out an investigation that led to Trump's indictment in March 2023. Trump faces charges of falsifying business records linked to payments made to Stormy Daniels during the 2016 presidential campaign. The transaction aimed to hide an alleged affair with the adult film star that occurred in 2006. Despite these issues, Trump vehemently denies the allegations thrown at him.

Trump's Social Media Storm

Before the impending trial, Trump took to the Truth Social platform, airing grievances against New York attorney Mark Pomerantz and Michael Cohen, his former lawyer turned critic. His post, attacking both individuals, raised many eyebrows. His message read, "Has Mark POMERANTZ been prosecuted for his terrible acts in and out of the DA's Office? Has disgraced attorney and felon Michael Cohen been prosecuted for LYING? Only TRUMP people get prosecuted by this Judge and these thugs! A dark day for our Country. MAGA2024!!!"

Where Does Trump's Behavior Cross the Line?

The main issue with this social media tirade is that it might violate a gag order set forth by Judge Merchan in March. The order imposes a ban on Trump's public comments on witnesses, which includes Cohen and Daniels, plus all individuals involved in the case and their families. While the order initially sidestepped Merchan and Bragg, it was later extended to include their families after a scathing attack against Loren Merchan, the Judge's daughter.

Recalling Trump, Cohen, and Pomerantz's History

It's important to remember that Cohen has already served his prison sentence after pleading guilty to eight criminal counts in 2018, the breach of campaign finance protocols over the hush money issue with Daniels among them. In another case in November 2018, Cohen again pleaded guilty in a federal court for lying to Congress over statements about Trump's business dealings with Russia during his 2016 campaign.

Trump's criticism became personal when he spoke out against Loren Merchan. He addressed her position with Authentic Campaigns, a political consulting firm partnered with Vice President Kamala Harris' 2020 presidential campaign and the Biden-Harris campaign.

Trump's spokesperson, Steven Cheung, labeled Judge Merchan's expanded gag order unconstitutional. He stated, "Judge Merchan's unconstitutional Gag Order prevents President Trump-the leading candidate for President of the United States-from engaging in core political speech, which is entitled to the greatest extent of protection under the First Amendment."
