Google, Meta, and Other Social Media Giants Unite To Contest Utah's Parental Consent Law

In a developing episode, popular social media powerhouses Google, Meta, TikTok, and several others have come under a single banner, united against Utah's recently revised parental consent law. The delegation taking on this case includes an ensemble of juggernauts represented by NetChoice, a trade association of nearly three dozen internet companies that act as the collective spine for the online world.

Curbing Digital Freedom or Promoting Safety?

Utah's freshly minted Social Media Regulation Act is at the heart of the matter. Set to be instated in March, this law stipulates that digital platforms must verify user ages and gain parental consent for all minor users. However, the regulation does not halt there. It further squeezes minors' access to accounts between the late hours of 10:30 p.m. and the early dawn of 6:30 a.m. and altogether prohibits advertising and data collection on their accounts.

In defiance, NetChoice presented their counter-argument in Monday's filing asserting that the Utah law severely distorts the First Amendment. They declare it an "unconceivable attempt to regulate and limit both minors' and adults' access to-and ability to engage in-lawfully protected expression actively."

A Law Singling Out Specific Sites - Fair or Unjust?

Breaking down the law effectively restricts who can communicate, what discourse is permissible, and how the dialogue can unfold. These regulations can dictate the precise time of day minors can use specified websites. NetChoice has also raised the question of why specific platforms such as YouTube, Facebook, and X are set apart for regulation based on a nebulous series of definitions and exceptions with arbitrary limits.

Chris Marchese, director of the NetChoice Litigation Center, amplified this concern, adding that "NetChoice believes that families equipped with educational resources are capable of determining the best approach towards online services and privacy protections for themselves."
