The ongoing case between Kesha Rose Sebert and her rivaled producer Dr. Luke, real name Lukasz Gottwald, has taken a full turn after the mother of Kesha, Pebe Sebert, has withdrawn some of her allegations against the producer. Dr. Luke may have completely dodged a bullet, though, the lawsuit is still far from over.
According to Fact Mag, the square off continues between Kesha and Dr. Luke over the allegations that he sexually abused her, contradicting that of his claim that Kesha is attempting to repudiate a recording agreement. In terms of progress, Dr. Luke seemingly has the upper hand, as a New York judge rejected her bid for a preliminary injunction and as one of her counterclaims was dismissed earlier in the month.
As per The Wrap, the litigation takes place in three states; New York is one, but apart from it, there is also one lawsuit in California brought by Kesha that was put on hold, and an ongoing clash between Dr. Luke and Kesha's mother in Tennessee. For that particular one, Dr. Luke consistently sues Pebe on her claims of defamation and tortious interference.
The complaint states that Kesha schemed with her mother to possibly elevate a contract disagreement into what is labelled as a 'smearing' of Dr. Luke. As the said extortion did not succeed, there were emails to bloggers and others within the industry that went around; rampantly saying that Dr. Luke was cordially being accused of rape.
Hollywood Reporter delivered that Pebe filed her own counterclaims of intentional and negligent infliction of emotional distress, which was based off the supposed abuse given to Kesha in the past. She also spoke of misrepresentations and fraudulent inducement by pushing that Dr. Luke gave his word that she would be involved in her daughter's career, being included as a song writer.
Pebe voluntarily withdrew her counterclaims, and was said to have detached from attorney Mark Geragos. Alex Little, Pebe's representing attorney, was quoted on his defense, saying, "The litigation with Dr. Luke has been a nightmare for Mrs. Sebert and her family. She has decided to move on and find peace and forgiveness in her heart rather than dwelling in the cancerous past of an ongoing lawsuit with no end in sight."
In the same manner, Dr. Luke's attorney, Christine Lepera, elaborated, "Pebe Sebert's voluntary withdrawal of all her claims against Dr. Luke is her acknowledgement that her claims are meritless. Dr. Luke's defamation and other claims continue against Pebe and Kesha Sebert."
The preliminary injunction's denial is cordially going up to a New York appeals court, while Dr. Luke's attorneys plan to depose Kesha and Pebe in June of this year.
