A day after Andrea Constand's case against Bill Cosby was ruled to continue, the other effort of the comedian and his team to drop the Judy Huth case was also given the go signal to proceed. The lawsuit by Huth claims that she was abused by Cosby at the Playboy Mansion when she was underage.
In a report by KSHB, Los Angeles Court Judge Craig Karlan is allowing Huth's lawsuit to proceed but he dismissed an infliction of emotional distress claim. This comes after Cosby's team challenged the case on various procedural grounds such as Huth waiting too long to sue the comedian.
Karlan added that the court is not willing to dismiss the plaintiff's "potentially meritorious claims" against defendant based upon mistakes attributable to her former counsel, CTV News reported.
Huth sued Cosby back in 2015 and she alleged that the comedian forced her to perform a sex act on him at the Playboy Mansion back in 1974. She was only 15 years old back then and she is now in her 50s, Sky News reported.
The attorney of Huth, Gloria Allred, said in a statement that the decision of the judge is a vindication of their position that the lawsuit by her client should be permitted to proceed to trial. Allred added that they did not believe there was any valid basis for denying Huth her day in court.
An email sent to the spokeswoman of Cosby, Monique Pressley, has not been returned yet. The former attorney of Cosby claimed that Huth's former lawyer extorted Cosby for $250,000 before the lawsuit was filed. Cosby and his attorneys will be given changes to seek for the dismissal of the case before trial but Karlan said that the plaintiff and the defendant no longer have to give additional sworn testimony in order to give more time to the comedian and his team regarding the Constand case.
Earlier, a judge in Manhattan also rejected the attempt of Cosby and his team to force the publisher of New York magazine to give the notes and other materials that were used in a cover story last year. The article was about 35 women who claimed they were sexually assaulted by Cosby. In total, more than 50 women claimed that they had sexual encounter with the comedian.
