A United States-based sperm bank, which has a Canadian distributor, is being sued by three families. The families reportedly found out that the company lied to them about the real information of the sperm donors.
Tech Times reported that the Georgia-based distributor sperm bank Xytex Corporation and its Canadian partner called Outreach Health Services misled the three families willfully into believing that Donor 9623 was a perfect donor. The sperm bank reportedly claimed that the donor is healthy, popular, and highly educated.
However, the families in Ontario, Canada claim that the donor was diagnosed as a schizophrenic and has a narcissistic personality disorder. The man also is a convicted burglar and did not attain any kind of the degrees listed under him as per the sperm banks' claims. The families then allege that the sperm bank knew the information and chose not to disclose it to any of them.
The lawyer of the families, James Fireman, also said the sperm bank misrepresented the donor as they claimed he has an IQ level of a genius, Stuff.co.nz reported. The donor reportedly fathered around 36 children. Fireman added that Xytex Corporation continued to sell the sperm "even after it knew the truth about the donor's health, his education, and his criminal past."
Accordingly, the families filed the lawsuit after the donor, identified as James Christian Aggeles, admitted he lied about his illness, education, and criminal record. Aggeles also noted that no one in Xytex Corporation questioned him when he filled out the questionnaire. He also said that no one in the company questioned about him working on a PhD in neuroscience engineering, The Star reported.
The families are suing for a total of $15.4 million in damages, allege fraud, wrongful pregnancy and negligent misinterpretation.
The lawyer representing Xytex Corporation, Ted Lavender, said the company will defend itself from the lawsuits and that the claims of the families have no basis or proof. He added that the company is an industry leader and "complies with all industry standards."
