Erin Andrews will return to Nashville for the trial of the $75 million civil suit that she filed against Windsor Capital Group and David Barnett after the jury selection. The lawsuit resulted from the leaked nude videos of Andrews back in 2008.
Andrews stayed at the Marriott in Vanderbilt University in 2008 while she covered a Vandy football game for ESPN, WJHL reported. Barrett stayed in the room next door and has since admitted making secret nude recordings of Andrews and distributing the said videos without her consent.
Andrews alleges that someone from the hotel tipped Barrett about her whereabouts. Apparently, Barrett took the videos while she was changing clothes in the hotel room, Sporting News reported. She claims that Barrett, then 50, created a peephole to invade her privacy. Barnett pleaded guity to the stalking, and invasion of privacy charges and has since been sentenced to 30 months in jail.
On the other hand, Andrews is suing Marriott for charges of negligence, infliction of emotional stress and invasion of privacy. In late January, Circuit Court Judge Hamilton ruled against Andrews holding that the franchisor is not responsible for the security of its individual franchises, USA Today reported.
Marriott International Inc., has since released an official statement. Albeit sympathetic to Andrews' plight, but blames a third party about the ordeal.
"As we have maintained since this matter first came to our attention, however, Marriott International was not responsible for what happened to Ms. Andrews, and we are pleased that the Court has dismissed Marriott International from the case. Marriott International continues to be sensitive to the serious nature of this matter and remains committed to the safety and comfort of our guests."
Motions and pre-trial documents of the case is under seal. This documents are expected to come forward after the jury selection. The trial is slated to last for 10 days.
