Driver of the school bus who ran over and killed an Elementary school principal in Indiana will not be indicted. The driver said it failed to engage the parking brake as it rolled its way killing the said principal while saving students from being struck by the vehicle last month.
According to INDY Star, Christine Beeler, the bus driver will not be facing criminal charges after Marion County prosecutor's office reviewed the details of the incident. The prosecutor on the case said the decision not to indict the driver was the fact that she was not impaired, when she left her seat.
Terry Curry, the prosecutor working on the case said the decision was based on a number of factors, including video of the incident and the fact that the driver was not impaired by drugs or alcohol. Adding it in Indiana law, negligence without impairment is not grounds for charging someone with a crime.
Susan Jordan, the 60 year old principal was killed while two students, both ten years old were injured, CNN News reported. The incident happened in 26th of January, in front of Amy Beverland Elementary School in Lawrence Township, located near Indianapolis.
By standers who witnessed the incident said the principal saved the two by pushing them out of the way. The said bus was parked in front of the school as it waited for children to ride them home. Police reported, the bus driver had already loaded the bus with the children passengers, however, left the driver seat without re-engaging the parking brake. The reason why the driver got out of the bus was not provided on the reports.
There was no finding of mechanical problems on the bus. Lawrence Township Schools released their official statement regarding the incident. It said the school officials are grateful for the outpouring of support and concern for everyone affected by the tragedy.
