In the mid-season finale of "Suits" Season 5, Mike's secret went back to haunt him. Mike has been arrested for "conspiracy to commit fraud" just when Harvey decided to step down to save the firm from Charles Forstman in Episode 11.
During the hiatus, Actor Patrick J. Adams told Backstage that the episode could have been done 2 years ago but said that he is excited as to what the twist offers for the character. As for the snitch who sold Mike out, showrunner Aaron Korsh told EW that it is someone who have a self-serving purpose.
Nonetheless, the twist came in an unfortunate time when Mike and Rachel are in the middle of their wedding preparations. Considering that Rachel is also guilty by association, E! Online asked Meghan Markle if we'd see spousal privilege come into play.
'Suits' Season 5 episode 11 opened with Mike waiting in the interrogation room. ADA Anita Gibbs (Leslie Hope) makes it clear that she is not messing around. Mike plays it cool and tricks her into a confession, provided his statement is caught on a videotape. Mike spoke on tape and asked for his lawyer until Anita realized what he was up to.
Robert Zane (Wendell Pierce) entered the interrogation room as Mike's counsel. Rachel asked him to represent Mike because she thought Jessica (Gina Torres) would want Harvey steer clear from Mike.
Robert told Mike to give up Harvey but Mike wouldn't have it. Frustrated, Robert tells Mike that he is on his own.
Harvey came in as the new counsel for Mike. At this point, Mike panics but Harvey is confident that they can win the case. Harvey reminds Mike that his name is on the roll of attorneys. Second, Mike has a diploma from Harvard. Third, the burden is with the DA to prove that he is not a lawyer.
In the meantime, Jack Soloff (John Pyper-Ferguson) uses the opportunity to scare Jessica. Jessica turns to Louis to find a solution only to shut it down when Louis asked her to promote Jack and make him the managing partner.
Meanwhile, Rachel is visibly weary and Donna wants to know how her friends are doing especially Harvey. Louis told her that it is not a good idea because the DA might make her a suspected co-conspirator.
In court, Anita asked the judge to strike Harvey accusing him of co-conspiracy. Mike told the judge that Anita violated his constitutional right when she asked incriminating questions in the interrogation room without his lawyer.
Harvey and Mike knew that they need to find a way to let Harvey stay in the firm when Anita suspected that Harvey have stepped down. If Harvey decides to revoke his resignation and stay, Forstman should be kept out of the loop. If he decides to make good with his arrangement with Forstman, his resignation can be used as evidence of conspiracy with Mike. Mike realizes that the ball in on his court all along.
Mike goes to see Jack in his office and tells him to back off. Mike tells Jack that if he informs Forstman that Harvey revoked his resignation, he will point at Jack at his co-conspirator.
In the end of the episode 11 of 'Suits' Season 5, Louis finally frees Donna so that she could help Harvey. Jessica heard what he did so she went to see him and apologized.
