American business magnate Donald Trump is thinking of suing Texas Senator and Republican presidential candidate Ted Cruz over the legality of his US citizenship.
According to CNN, Trump suggests since there is a Constitutional requirement that the president must be a natural-born citizen, the senator from Texas would be ineligible since he was born in Canada.
The former 'The Apprentice' host said that Cruz's Canadian birth may be a danger to Republican victory since Decomcrats will use this issue to keep Cruz out of the White House.
Cruz insisted that he was an American citizen by birth because he was born to an American mother. Most legal experts also agree with Cruz, but this issue has never been brought up in a federal court.
FOX News reports that Cruz was a Canadian citizen due to being born there and held dual citzenship because of his american mother. Cruz did not realize his citizenship status until 2013 and has officially renounced his Canadian citizenship last May 2014.
What defines an American Citizenship has always been subject to debate and the Supreme Court has no formal ruling on this criteria for presidential office holders.
2008 Republican presidential candidate John McCain also faced questions on his citzenship. McCain was born in the Panama Canal Zone, a US territory at the time.
In a radio interview in early January, McCain said to a Phoenix radio station that his situation was different over that of Ted Cruz. He said that he didn't know about Cruz's eligibility in the presidential race but added that it's "worth lookig into".
Trump however, for all the ruckus he created on this issue, thinks this is not worth looking into.
In an interview with The Hill, Trump has said that he believes that he can defeat Cruz without legally challenging the citizenship issue and which is why he will probably not sue.
Cruz, on the other hand, made a parting jibe at Trump. He said that under some theories, Trump would also be ineligible to run for president since his mother was born on Scotland.
