James Holmes Trial Update: Aurora Suspect to Face the Death Penalty? Fox News Reporter Fights to Shield Sources

District Attorney George Brauchler announced the hiring of one of the most renowned death penalty prosecutors to join his team, indicating that capital punishment may be sought against the alleged Aurora, Colorado shooter James Holmes.

Throughout the course of Zook's career, he has personally overseen four death penalty cases.

"Dan is the most experienced death penalty prosecutor in the state of Colorado and a national expert on these cases," read a press release, and was reported on Colorado's Channel 9 station.

A decision on whether to seek the death penalty in the Holmes case is still months away.

Prosecutors have nine weeks from the date of arraignment on deciding on whether to pursue the death penalty. Holmes' team has yet to enter a plea and his arraignment is scheduled for March 12.

Also, in a letter made public on Thursday, Jana Winter, a Fox News reporter said she will fight any attempt to force her to reveal her sources about a story concerning Aurora Colorado theater suspect Holmes.

The suspect's attorneys have tried to coerce Winter to disclose her sources for a news story, in which describes the contents of a notebook Holmes sent to a psychiatrist before the shooting at an Aurora movie theater in July, ABC News reports.

Winter's lawyer, Dori Ann Hanswirth, has said in a Jan. 29 letter to Holmes' attorneys that shield laws in New York and Colorado, protecting her from revealing the sources.

"We urge the defense to abandon its pursuit of testimony from Ms. Winter," the letter reads.

Her attorney sent a copy of the letter to prosecutors, who then submitted it to the judge in a motion.
