GovGuam appeals to the US Supreme Court for the Tax Refund

By

After the unsuccessful aims for justice, the government of Guam is making an appeal to the highest court in place, U.S Supreme Court. The class action lawsuit aims on clarifying and obtaining justice from payments regarding tax refunds.

It was previously reported by Kuam that a class action lawsuit over the payment of tax refunds continues and the Government of Guam is disagreeing over the payment of tax refunds and attorney fees, as well as resolving issues over Guam's current relationship with the federal government.

The post further explained a writ of certiorari is not obligatory but an optional appeal. Tech Law Journal defines it by firstly explaining its Latin word which mean to be informed of, or to be made certain in regard to, and it is also the name given to certain appellate proceedings for re-examination of actions of a trial court, or inferior appeals court.

Moreover, Arthur Clark, chief policy advisor for Governor Eddie Calvo commented, "As the governor likes to say, these interpretations out of the Ninth Circuit were neither fish nor fowl, or were fish when it's convenient and fowl when it's convenient for the federal government."

It was just months ago that the Ninth Circuit Court of Appeals denied the Government of Guam's petition to consider the case related to the class action lawsuit over the payment of tax refunds.

Additionally, a You Tube video was posted regarding the case was posted and it revealed the desire of GovGuam of being granted a full panel review on the payment of attorney fees on the case and much more.

Furthermore, the law system of the country is shifting and everyone does not so readily accept the changes all across the various states. As for the government of Guam, the state needs to strengthen their countermeasures to gain the needed resolution that they so desired.
