Senate Confirms Controversial Justice to 9th Circuit

Washington. - Arizona Supreme Court Justice, Andrew David Hurwitz, has been appointed and confirmed by the Senate to sit on the 9th U.S. Circuit Court of Appeals Tuesday. The 9th circuit includes Washington, Oregon, Alaska, Idaho, Montana, Nevada, California, and Arizona.

Mr. Hurwitz won approval despite objections from the conservatives, particularly for his role in the 1973 Supreme Court decision legalizing abortion. Hurwitz had served as a clerk for Jon Newman, U.S. District Judge of Connecticut, who wrote the opinion for the landmark case, Roe v. Wade that legalized abortion.

Mr. Hurwitz received a nominated in November of 2011 from President Obama. Mr. Hurwitz was confirmed through a voice vote today, according to Associated Press. The vote was supported by only two republican senators from Arizona.

Mr. Hurwitz is 65 years old; he is originally from New Jersey and earned his J.D. from Yale University. He was appointed to the Arizona Supreme Court in 2003 by the governor of Arizona, Janet Napolitano. Then in 2009 was elected chief justice of the Arizona Supreme Court.
