Can The Police Detain You Before Issuing a Warrant

Washington - The U.S. Supreme Court will decide whether the police can follow and detain without a warrant. According to the Associated Press, the Supreme Court declared Monday that it will hear the case of Bailey v. United States, 11-770, in which bailey claims he was detained before the police issued a warrant.

According to the case, Chunon Bailey was asked by the police to leave his apartment so that they could conduct a search. The police did not have a warrant at the time of request. However, Bailey obliged, but argued than upon leaving the apartment, the police constantly followed him the whole time he was out and then arrested him before issuing the warrant. He told the court that he was "unconstitutionally stopped and brought back to the apartment," as reported by the Associated Press.

Bailey filed suit against the police, the trial judge ruled in favor of the police. However, the federal court of appeals ruled the contrary. The Supreme Court will have the final say later this month.

Chunon Bailey was charged and sentenced to 30 years in prison on drug and weapon charges in 1999.
